Charges against CPS workers – Where are the cameras?

Phone for NY Court Cameras

Today, Newsday, a Long-Island based newspaper, has indicated that a grand jury is looking into criminal charges with respect to the death of Thomas Valva; however, there were no cameras in the courts to provide direct evidence as to what happened. Valva died due to abuse and was later murdered by his father and the father’s fiancée. The issue raised was that many reports of abuse had been received by county employees, yet they did not act on the information, leading to the tragedy.

The grand jury investigating this matter may result in criminal charges against the Child Protective Services employees, who neglected their duty to protect Thomas Valva. The jury may also scrutinize the workings of CPS, leading to recommendations for reforms that will improve the agency’s efficiency. Had cameras been installed in the courtroom, the grand jury would have evidence to review.

The process of holding CPS employees accountable is difficult as the standard of proof is high. However, if the grand jury finds that CPS employees were aware of the significant risk to Valva’s life, they may face criminal charges ranging from criminally negligent homicide to manslaughter. The indictment requires the votes of 12 of the 23 jury members.

Besides seeking indictments, the grand jury has the authority to recommend terminations or other disciplinary actions for CPS employees who fail in their duties. With the ability to subpoena witnesses, the grand jury has a distinct advantage over other investigative entities. It can require CPS employees who received and reviewed reports of abuse to testify, as well as judges who presided over the custody and visitation cases. The grand jury can also recommend cameras in the courtoom.

Therefore, the importance of having cameras in courtrooms cannot be overemphasized. In this case, the grand jury would have all the information they need to deliver justice. It is essential to have a transparent and accountable judicial process that protects children and the vulnerable. Advocates for cameras in courtrooms are on the right track in fighting for justice and accountability.

It is necessary to have a transparent and accountable judicial process that protects children and the vulnerable. The government needs to pass legislation for the installation of cameras in all courtrooms. This will ensure that the right decisions are made in the pursuit of justice. It will also restore public confidence in the system and ensure that we never have another case like Thomas Valva.
